DMCA Policy

Gary Player Augusta respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Gary Player Augusta will respond expeditiously to claims of copyright infringement committed using the Gary Player Augusta service and/or website (the "Site") if such claims are reported to Gary Player Augusta's Designated Copyright Agent identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Gary Player Augusta's Designated Copyright Agent.

Upon receipt of the Notice as described below, Gary Player Augusta will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Please note that if you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) of the page(s) containing the material).
  3. Provide your full legal name, mailing address, telephone number, and email address.
  4. Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Provide your electronic or physical signature.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a Counter-Notification to Gary Player Augusta's Designated Copyright Agent containing the following information:

  • Identify the specific URLs or other unique identifying information of material that Gary Player Augusta has removed or to which Gary Player Augusta has disabled access.
  • Provide your full legal name, mailing address, telephone number, and email address.
  • Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which Gary Player Augusta may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Provide your electronic or physical signature.

Upon receipt of a valid Counter-Notification, Gary Player Augusta may forward it to the party who submitted the original DMCA Notice. The original DMCA Notice provider will then have 10 business days to notify us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our Site. If we receive no such notification within 10 business days, we may, in our sole discretion, reinstate the removed material or cease disabling access to it.
